These Terms of Service ("Terms") govern your access to and use of the BeBetter mobile application and the bebetter.now website (together, the "Service"), operated by BeBetter ("we", "us", or "our"). By downloading, accessing, or using the Service, you agree to be bound by these Terms. If you do not agree, please do not use the Service.

1. Use of the Service

BeBetter provides habit-tracking, planning, and AI-assisted coaching tools to help you build and maintain habits. You agree to use the Service only for lawful purposes and in accordance with these Terms. You are responsible for any activity that occurs under your account.

2. App License (Apple Standard EULA)

The BeBetter app is licensed, not sold, to you. Your license to use the app is governed by Apple's Licensed Application End User License Agreement (the "Standard EULA"), available at apple.com/legal/internet-services/itunes/dev/stdeula. You acknowledge and agree that, with respect to your license to use the app, the Standard EULA applies. In the event of any conflict between these Terms and the Standard EULA regarding that license, the Standard EULA shall govern. Apple and its subsidiaries are third-party beneficiaries of the Standard EULA and may enforce it against you.

3. Accounts

Some features require an account. You agree to provide accurate information and to keep your credentials secure. You are responsible for maintaining the confidentiality of your account and for all activities that occur under it.

4. Subscriptions and Purchases

BeBetter is free to download and offers optional in-app purchases and subscriptions. Payments are processed by Apple through the App Store. Subscriptions renew automatically unless cancelled at least 24 hours before the end of the current period. You can manage and cancel subscriptions in your App Store account settings. Refunds are handled by Apple in accordance with the App Store terms.

5. AI Coaching Disclaimer

The AI coach provides motivational and informational guidance only. It is not a substitute for professional medical, psychological, financial, or other expert advice. Always seek the advice of a qualified professional for any decision that may affect your health or wellbeing.

6. Intellectual Property

The Service and its original content, features, and functionality are and will remain the exclusive property of BeBetter and its licensors. You may not copy, modify, distribute, or reverse-engineer any part of the Service without our prior written consent.

7. User Content

You retain ownership of the habits, goals, and other content you create in the Service. You grant us a limited license to store and process that content solely to operate and improve the Service, as described in our Privacy Policy.

8. Termination

We may suspend or terminate your access to the Service at any time, without prior notice, if you breach these Terms. You may stop using the Service at any time by deleting your account and removing the app from your devices.

9. Disclaimer of Warranties

The Service is provided on an "as is" and "as available" basis without warranties of any kind, whether express or implied. We do not warrant that the Service will be uninterrupted, secure, or error-free.

10. Limitation of Liability

To the maximum extent permitted by law, BeBetter shall not be liable for any indirect, incidental, special, or consequential damages arising out of or in connection with your use of the Service.

11. Changes to These Terms

We may update these Terms from time to time. We will notify you of material changes by posting the new Terms on this page and updating the "Last updated" date. Your continued use of the Service after changes take effect constitutes acceptance of the revised Terms.
